The ICCW Program is to assist Indigenous people charged with a criminal offence under the code. The worker is to provide advocacy to Indigenous people involved in the justice system to better understand their rights, options and responsibilities when appearing before the courts.
The services the Criminal Court worker provides are:
- Attend court and advocate for persons appearing before the court
- Explain court procedures/processes
- Explain the nature and consequences of legal matters faces by the person
- Explain someone’s rights, responsibilities, and options under the law
- Explain the philosophy of the justice system
- Act as a advocate by providing the court with relevant information
- Discuss plans of action with lawyer/duty counsel to present to court
- Make referrals to legal and community resources
- Explain court dispositions or directions afforded by the court
- Define legal terminology in layman’s terms
- Negotiate diversions to community justice/alternative justice programs
- Negotiate with Crowns on behalf of unrepresented persons
- Provide the mainstream justice system with information about Indigenous issues and values concerning justice
- Liaise between accused, court officials, and others
- Explain and assist with the completion of court forms, affidavits etc
